TITLE 18, U.S.C., SECTION 242

OFFICER PABLO LOPEZ
The wrongful arrest/kidnapping/sexual assault of John back in June 2006 by Santa Clara Officer Pablo Lopez (and another shaved headed idiot UC Officer) was done after John had been violently attacked by Mister Olenak with no arrests ever made. (NOTE: Mister Olenak later admitted to attacking John at an administrative hearing with Judge Louis Amadeo Junior). In the process of the June 2006 wrongful arrest; Pablo Lopez ground his genitals against Johns' waist essentially sexually assaulting John in the process. And this is something Officer Lopez had allegedly done to Johns' friend Greg as well during another previous arrest.

(This is not something John has wanted to talk about until now...what man wants to admit that he has been sexually assaulted by another man; LET ALONE A POLICE OFFICER!?!)

Gregs' Mother died in 1999 right after Johns' brother Carl died; causing John and Greg to become best friends; along with Danny Garcia who lost his Mother around the same time (go to: HIS STORY REPEATS ITSELF @ http://addendumblog1.blogspot.com/2013/02/his-story-repeats-itself.html). Greg started drinking alcohol in excess after the death of his Mother; causing Greg to essentially spin out of control in the process.

One night around this time in front of the old lesbian nightclub "The Savoy" in Santa Clara; a group of about 5 women encouraged Greg to pull his pants down (yup; you read it right). Causing Greg to respond in kind to their needs. Just then two females within the group allegedly became offended by Gregs' "penal code" violation and called the Santa Clara Police Department.

(Maybe because Gregs' penis was too small? I am not exactly sure why. But since Greg is a heterosexual and the ladies in question were/are homosexuals; due to the obvious conflict of interest -- both sides should effectively cancel each other out in the process; should they not?)

Pablo Lopez responded to the 911 call and proceeded to sexually assault Greg in the process of this arrest as well; like he had done to John. Greg said that a "sweaty" Officer Lopez ground his genitals up against Greg during this arrest as well; essentially assaulting Greg in in the process

Officer Lopez then took Greg to a holding cell and began questioning Greg. At some point Officer Lopez left the cell and returned later saying Greg was growing and/or selling Marijuana. When Greg returned later to his home; a front window had been broken allowing someone to open the window and gain entry into the house. (SEE: "sneak and peak searches" > Note: There was blood on the glass fragments that should have been kept as evidence -- very likely Pablo Lopezs' blood).

To make a long story short; Greg was later released and thankfully not required to register as a sex offender; and no arrests were ever made regarding the Marijuana (likely because Gregs' roommate Mickey has a brother who works and/or worked for Sunnyvale D.P.S. -- Mickey had allegedly gone on hunting trips with Alex Fagan Junior).

TITLE 18, U.S.C., SECTION 242 -- Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

NOTES: Even though John DID NOT resist arrest; please consider: 1) “An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.” (State v. Robinson, 145 ME. 77, 72 ATL. 260). / 2) “Each person has the right to resist an unlawful arrest. In such a case, the person attempting the arrest stands in the position of a wrongdoer and may be resisted by the use of force, as in self- defense.” (State v. Mobley, 240 N.C. 476, 83 S.E. 2d 100). / 3) One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910). / 4) “When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justified.” Runyan v. State, 57 Ind. 80; Miller v. State, 74 Ind. 1. / 5) “Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary.” Plummer v. State, 136 Ind. 306.
